Any unauthorized use of our intellectual property may result in immediate legal action and claims for damages, injunctive relief, and attorney’s fees.

    12. Cancellation, Refund, and Change Policies

However, we cannot control the timing of refund processing by airlines and other service providers. Some refunds may be processed as travel credits rather than monetary refunds, depending on the applicable fare rules.

    Change and Modification Policies

    Changes to existing bookings are subject to availability, fare rules, and the policies of service providers. Common changes include date modifications, route changes, and passenger name corrections. Change fees and fare differences may apply, and some fare types do not permit changes.

    We recommend requesting changes as early as possible to maximize options and minimize potential fees. Complex changes may require cancellation and rebooking, which could result in loss of original pricing and availability. We will provide information about change options and associated costs before processing any modifications.

    Force Majeure and Extraordinary Circumstances

    In cases of force majeure events or extraordinary circumstances such as natural disasters, political unrest, pandemics, or other events beyond our control, special cancellation and change policies may apply. Airlines and other service providers may waive normal fees and restrictions during such events.

    BusinessClass-Flights will assist customers affected by extraordinary circumstances and work with service providers to minimize disruption and additional costs. However, we cannot guarantee that normal fees and restrictions will be waived, as such decisions are made by the individual service providers.

    13. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIABILITY OF BUSINESSCLASS-FLIGHTS FOR ANY CLAIMS, DAMAGES, OR LOSSES ARISING FROM OR RELATED TO THESE TERMS OF USE, OUR SERVICES, OR YOUR USE OF OUR PLATFORM SHALL BE LIMITED AS FOLLOWS:

    Exclusion of Consequential and Indirect Damages

    IN NO EVENT SHALL BUSINESSCLASS-FLIGHTS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, EVEN IF BUSINESSCLASS-FLIGHTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    Monetary Limitation of Direct Damages

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUSINESSCLASS-FLIGHTS' TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT OF SERVICE FEES PAID BY YOU TO BUSINESSCLASS-FLIGHTS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) FIVE HUNDRED DOLLARS ($500).

    Third-Party Service Provider Limitations

    BUSINESSCLASS-FLIGHTS SHALL NOT BE LIABLE FOR THE ACTS, OMISSIONS, CONDUCT, OR PERFORMANCE OF THIRD-PARTY SERVICE PROVIDERS, INCLUDING BUT NOT LIMITED TO AIRLINES, HOTELS, CAR RENTAL COMPANIES, OR OTHER TRAVEL SERVICE PROVIDERS. YOUR RECOURSE FOR ISSUES WITH THIRD-PARTY SERVICES IS SOLELY AGAINST THE RESPECTIVE SERVICE PROVIDER.

    Technology and System Limitations

    BUSINESSCLASS-FLIGHTS SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE RESULTING FROM SYSTEM DOWNTIME, TECHNICAL FAILURES, INTERNET CONNECTIVITY ISSUES, DATA LOSS, OR OTHER TECHNOLOGY-RELATED PROBLEMS. OUR SERVICES ARE PROVIDED «AS IS» AND «AS AVAILABLE» WITHOUT WARRANTIES OF UNINTERRUPTED OR ERROR-FREE OPERATION.

    Travel-Related Limitations

    BUSINESSCLASS-FLIGHTS SHALL NOT BE LIABLE FOR TRAVEL DELAYS, CANCELLATIONS, MISSED CONNECTIONS, LOST BAGGAGE, OR OTHER TRAVEL-RELATED ISSUES CAUSED BY AIRLINES OR OTHER SERVICE PROVIDERS. WE SHALL NOT BE LIABLE FOR CHANGES IN AIRLINE SCHEDULES, ROUTE MODIFICATIONS, OR SERVICE DISRUPTIONS BEYOND OUR CONTROL.

    Information and Advisory Limitations

    BUSINESSCLASS-FLIGHTS PROVIDES INFORMATION AND ADVICE BASED ON AVAILABLE SOURCES, BUT WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF SUCH INFORMATION. WE SHALL NOT BE LIABLE FOR DECISIONS MADE BASED ON INFORMATION PROVIDED BY US OR FOR CHANGES IN TRAVEL REQUIREMENTS, VISA POLICIES, OR OTHER REGULATIONS.

    14. Indemnification

    User Indemnification Obligations

    You agree to indemnify, defend, and hold harmless BusinessClass-Flights, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, actions, damages, losses, costs, and expenses (including reasonable attorney's fees and court costs) arising from or related to:

    Information Accuracy: Any inaccurate, incomplete, false, or misleading information provided by you, including but not limited to personal information, travel preferences, payment information, travel documentation, or any other information submitted to us or our service providers.

    Breach of Terms: Your violation of any provision of these Terms of Use, our Privacy Policy, or any other agreement between you and BusinessClass-Flights, including but not limited to user conduct violations, payment defaults, or failure to comply with booking requirements.

    Third-Party Claims: Any claims by third parties arising from your travel arrangements, conduct during travel, use of our services, or interactions with service providers, including but not limited to claims for personal injury, property damage, or breach of contract.

    Legal Violations: Your violation of any applicable laws, regulations, or third-party rights, including but not limited to immigration laws, customs regulations, intellectual property rights, privacy rights, or consumer protection laws.

    Unauthorized Use: Any unauthorized use of our services, systems, or intellectual property, whether by you directly or by others using your account or credentials, including but not limited to fraudulent bookings, system abuse, or intellectual property infringement.

    Scope of Indemnification Coverage

    Your indemnification obligations include but are not limited to:

    Legal Defense Costs: All reasonable attorney's fees, court costs, expert witness fees, and other legal expenses incurred in defending against covered claims or enforcing this indemnification provision.

    Damages and Settlements: All damages, judgments, settlements, fines, penalties, and other monetary obligations arising from covered claims, whether imposed by courts, regulatory authorities, or agreed to in settlement negotiations.

    Business Losses: Any business losses incurred by BusinessClass-Flights as a result of covered claims, including lost profits, business interruption, reputational damage, and costs of remedial measures.

    Regulatory Actions: Any fines, penalties, sanctions, or other regulatory actions imposed on BusinessClass-Flights as a result of your conduct or violations, including costs of regulatory compliance and remediation.

    Indemnification Procedures and Requirements

    Legal Defense Costs: Notice and Defense: BusinessClass-Flights will provide you with prompt written notice of any claim for which indemnification is sought. You may assume the defense of the claim with counsel of your choice, subject to BusinessClass-Flights' reasonable approval. BusinessClass-Flights reserves the right to participate in the defense with counsel of its choice at its own expense.

    Cooperation: You agree to cooperate fully with BusinessClass-Flights in the defense of any claim and to provide all necessary information, documentation, and assistance. Failure to cooperate may result in additional liability and damages.

    Settlement Authority: You may not settle any claim without BusinessClass-Flights' prior written consent, which shall not be unreasonably withheld. BusinessClass-Flights may settle any claim at your expense if you fail to defend the claim adequately or if settlement is in BusinessClass-Flights' reasonable business judgment.

    Survival: Your indemnification obligations shall survive termination of these Terms of Use and shall continue for the maximum period permitted by applicable law.

    15. Force Majeure

    Definition and Scope of Force Majeure Events

    BusinessClass-Flights shall not be liable for any failure or delay in performance of its obligations under these Terms of Use when such failure or delay results from circumstances beyond our reasonable control. Force majeure events include but are not limited to:

    Natural Disasters: Earthquakes, hurricanes, floods, tsunamis, volcanic eruptions, wildfires, severe weather conditions, and other acts of nature that disrupt travel or business operations.

    Human-Caused Events: War, terrorism, civil unrest, labor disputes, strikes, government actions, regulatory changes, sanctions, embargoes, and other political or social disruptions.

    Technology and Infrastructure Failures: Cyberattacks, system failures, internet outages, power failures, telecommunications disruptions, and other technology-related events beyond our control.

    Public Health Emergencies: Pandemics, epidemics, disease outbreaks, quarantine requirements, travel restrictions, and other public health measures that affect travel or business operations.

    Third-Party Failures: Failures by airlines, hotels, payment processors, or other service providers that prevent us from performing our obligations, including bankruptcies, service suspensions, and operational disruptions.

    Effect of Force Majeure Events

    During force majeure events, BusinessClass-Flights' obligations under these Terms of Use shall be suspended to the extent that performance is prevented or delayed by the force majeure event. We will make reasonable efforts to minimize the impact of force majeure events and to resume normal operations as soon as practicable.

    Force majeure events may affect our ability to process bookings, provide customer support, communicate with customers, or deliver services according to normal timelines. We will provide updates and information about service disruptions as circumstances permit and will work to accommodate customers affected by force majeure events.

    Customer Responsibilities During Force Majeure Events

    During force majeure events, customers remain responsible for monitoring their travel arrangements, staying informed about changing conditions, and taking appropriate action to protect their safety and interests. This may include rebooking travel, obtaining travel insurance, or making alternative arrangements.

    BusinessClass-Flights will assist customers to the extent possible during force majeure events, but our ability to provide normal levels of service may be limited. Customers should maintain flexibility in their travel plans and be prepared to make adjustments as circumstances require.

    Limitation of Liability During Force Majeure Events

    BusinessClass-Flights shall not be liable for any damages, losses, or expenses resulting from force majeure events, including but not limited to additional travel costs, accommodation expenses, lost business opportunities, or other consequential damages. Our liability limitations apply with full force during force majeure events.

    Customers are encouraged to obtain appropriate travel insurance to protect against losses resulting from force majeure events and other travel disruptions. BusinessClass-Flights can provide information about travel insurance options but does not guarantee coverage or claims processing by insurance providers.

    16. Dispute Resolution and Arbitration

    Mandatory Binding Arbitration

    ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OF USE, OUR SERVICES, OR YOUR RELATIONSHIP WITH BUSINESSCLASS-FLIGHTS SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION RATHER THAN IN COURT, EXCEPT AS OTHERWISE PROVIDED HEREIN.

    All disputes shall be resolved through individual arbitration conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA) or another nationally recognized arbitration organization mutually agreed upon by the parties. The arbitration shall be conducted by a single arbitrator with substantial experience in commercial disputes and travel industry matters.

    Arbitration Procedures and Requirements

    Location and Venue: Arbitration proceedings shall take place in Sheridan, Wyoming, or another location mutually agreed upon by the parties. If the parties cannot agree on a location, the arbitrator shall determine the most appropriate venue considering the convenience of the parties and the nature of the dispute.

    Arbitrator Selection: The arbitrator shall be selected in accordance with AAA rules or through mutual agreement of the parties. The arbitrator must be neutral and impartial and shall have no financial or personal interest in the outcome of the arbitration.

    Discovery and Evidence: Discovery shall be limited to information directly relevant to the dispute and shall be conducted in an efficient and cost-effective manner. The arbitrator shall have authority to order appropriate discovery and to impose sanctions for discovery abuse.

    Confidentiality: All arbitration proceedings, including hearings, evidence, and awards, shall be confidential and may not be disclosed to third parties except as required by law or to enforce the arbitration award.

    Class Action and Collective Action Waiver

    YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS, CLASS-WIDE ARBITRATIONS, COLLECTIVE ACTIONS, OR OTHER REPRESENTATIVE PROCEEDINGS AGAINST BUSINESSCLASS-FLIGHTS. ALL DISPUTES MUST BE RESOLVED THROUGH INDIVIDUAL ARBITRATION.

    This waiver applies to all claims and disputes, whether based on contract, tort, statute, regulation, or any other legal theory. You may not serve as a class representative or participate as a member of a class in any class action or collective proceeding against BusinessClass-Flights.

    Exceptions to Arbitration Requirement

    The following matters are excluded from the mandatory arbitration requirement:

    Injunctive Relief: Claims seeking injunctive or other equitable relief to protect intellectual property rights, confidential information, or to prevent irreparable harm may be pursued in court.

    Small Claims Court: Claims that fall within the jurisdiction of small claims court may be pursued in such court, provided they remain individual claims and do not seek class-wide relief.

    Regulatory Proceedings: Proceedings before regulatory authorities or government agencies are not subject to arbitration requirements.

    Emergency Relief: Applications for temporary restraining orders or other emergency relief may be pursued in court when immediate action is necessary to prevent irreparable harm.

    Costs and Attorney's Fees

    Each party shall bear its own attorney's fees and costs in arbitration proceedings unless the arbitrator determines that an award of fees is appropriate under applicable law or these Terms of Use. Arbitration fees shall be allocated in accordance with AAA rules and applicable law.

    If you are unable to pay arbitration fees, BusinessClass-Flights may advance such fees subject to reimbursement if you do not prevail in the arbitration. Fee-shifting provisions in these Terms of Use or applicable law may apply to arbitration proceedings.

    Enforcement and Appeal:

    Arbitration awards shall be final and binding on all parties and may be enforced in any court of competent jurisdiction. The grounds for challenging an arbitration award are limited to those specified in applicable law, and judicial review of arbitration awards is extremely limited.

    Appeals of arbitration awards are not permitted except as specifically provided by applicable law. The arbitrator's decision shall be final and conclusive, and judgment may be entered upon the award in any court having jurisdiction.

    17. Privacy and Data Protection

for any reason, including but not limited to:

    Breach of Terms: Violation of any provision of these Terms of Use, our Privacy Policy, or any other agreement between you 
and BusinessClass-Flights.

    Fraudulent Activity: Suspected or actual fraudulent activity, including false information, unauthorized use of payment methods, or deceptive practices.

    Legal Compliance: Requirements to comply with legal obligations, court orders, or regulatory requirements that necessitate termination 
of services.

    Business Reasons: Business decisions to discontinue services, modify service offerings, or terminate customer relationships for strategic 
or operational reasons.

    Termination by User

    You may terminate your relationship with BusinessClass-Flights at any time by discontinuing use of our services and closing your account. Termination does not relieve you of obligations incurred prior to termination, including payment obligations and indemnification duties.

    Account closure may be requested by contacting our customer service team. Upon account closure, you will lose access to account features and stored information, and we may delete your account data in accordance with our data retention policies.

    Effect of Termination

    Upon termination of these Terms of Use:
