1. General Disclaimers and Limitations
Scope of Services and Limitations
BusinessClass-Flights operates as a travel intermediary and consultant, facilitating access to travel services provided by third-party suppliers including airlines, hotels, car rental companies, and other travel service providers. We do not own, operate, or control the actual travel services provided by these third parties, and our role is limited to consultation, booking facilitation, and customer support services.
While we strive to provide exceptional service and maintain high standards in all our operations, we cannot guarantee the performance, quality, or availability of third-party travel services. Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
The travel industry is subject to numerous variables and uncertainties that are beyond our control, including but not limited to weather conditions, mechanical issues, labor disputes, government regulations, security concerns, and other factors that may affect travel arrangements. We disclaim any responsibility for disruptions, delays, cancellations, or other issues arising from circumstances beyond our reasonable control.
Service Availability and Continuity
BusinessClass-Flights reserves the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We do not guarantee continuous, uninterrupted, or error-free operation of our website, mobile applications, or other service platforms. System maintenance, technical issues, security concerns, or other operational requirements may result in temporary service interruptions.
We make no representations or warranties regarding the availability of specific flights, fares, or travel services at any given time. Availability is subject to numerous factors including airline inventory management, seasonal demand fluctuations, special events, and other market conditions that are beyond our control. We cannot guarantee that any particular flight, fare, or service will be available when requested.
Our customer service and support operations are designed to provide assistance during normal business hours, with emergency support available for urgent travel-related issues. However, we cannot guarantee immediate response times or resolution of all issues, particularly during peak travel periods, system outages, or extraordinary circumstances.
Professional Service Limitations
While our travel consultants are experienced professionals with extensive knowledge of the travel industry, we do not provide professional advice regarding legal, medical, financial, or other specialized matters that may affect your travel plans. Customers are responsible for consulting with appropriate professionals regarding visa requirements, health and vaccination needs, travel insurance, and other specialized considerations.
Our recommendations and suggestions are based on general industry knowledge and experience but may not be suitable for all travelers or circumstances. We encourage customers to conduct their own research and make informed decisions based on their specific needs, preferences, and circumstances. We disclaim any liability for decisions made based on our recommendations or suggestions.
The travel industry is subject to rapid changes in regulations, policies, and procedures that may affect travel arrangements. While we make reasonable efforts to stay informed of industry developments, we cannot guarantee that our information is always current or complete. Customers are responsible for verifying current requirements and conditions that may affect their travel plans.
2. Pricing and Availability Disclaimers
Dynamic Pricing and Market Fluctuations
Airline ticket prices are inherently dynamic and subject to constant fluctuation based on numerous factors including demand patterns, booking timing, seat availability, fuel costs, currency exchange rates, and competitive market conditions. Advertised prices represent point-in-time snapshots and may not reflect current rates due to these continuous fluctuations, particularly on popular routes or during peak travel periods.
The airline industry employs sophisticated revenue management systems that adjust pricing in real-time based on booking patterns, historical data, competitive analysis, and demand forecasting. These systems may result in significant price variations within short time periods, and prices may increase or decrease without notice. We have no control over airline pricing decisions and cannot guarantee that any advertised price will remain available for any specific period.
Promotional fares and special offers are typically subject to limited inventory allocation and may be withdrawn without notice once capacity limits are reached. The availability of promotional pricing depends on numerous factors including booking timing, travel dates, route popularity, and overall market demand. We cannot guarantee the availability of any promotional fare or special offer beyond the time of actual booking confirmation.
Booking Requirements and Restrictions
All advertised rates and promotional offers are subject to specific terms and conditions that may include minimum passenger requirements, advance purchase deadlines, stay duration restrictions, blackout dates, and other limitations. These requirements are established by airlines and other service providers and are subject to change without notice. Failure to meet applicable requirements may result in higher pricing or unavailability of advertised rates.
Blackout dates and travel restrictions are commonly applied to promotional fares and may include major holidays, peak travel seasons, special events, and other high-demand periods. These restrictions are determined by individual airlines and service providers and may vary significantly between different fare types and routes. We provide information about known restrictions but cannot guarantee comprehensive coverage of all applicable limitations.
Group bookings, corporate travel arrangements, and other specialized booking types may be subject to different pricing structures, terms, and conditions than those advertised for individual travelers. These arrangements often require advance planning, minimum passenger commitments, and specialized agreements that may affect pricing and availability. We will provide specific information about applicable terms and conditions for specialized booking arrangements.
Specialty Travel Services
Quoted prices are estimates based on available information at the time of inquiry and are not guaranteed until confirmed through completed booking and payment processes. Price quotes are subject to change based on availability verification, fare rule application, and other factors that may not be apparent during initial inquiry processes. Final pricing is determined only upon completion of the booking process with full passenger details and payment information.
Payment requirements vary based on fare types, airlines, and booking circumstances. Some fares require immediate payment upon booking, while others may allow for delayed payment within specified timeframes. Failure to complete payment within required deadlines may result in automatic cancellation of reservations and loss of quoted pricing. We will clearly communicate payment requirements and deadlines for each booking.
Airlines and other service providers reserve the right to impose additional charges, fees, and surcharges even after final payment has been processed. These charges may include fuel surcharges, security fees, airport taxes, government-imposed charges, and other fees that are beyond our control. Such charges may be imposed up to the day of departure and are the responsibility of the traveler.
Rate Inclusions and Exclusions
Advertised rates typically represent base fares and may not include various taxes, fees, and surcharges that are required for travel. These additional charges may include government taxes, airport fees, security charges, fuel surcharges, and other mandatory fees imposed by airlines and government authorities. The total cost of travel may be significantly higher than advertised base fares due to these additional charges.
Advertised rates generally exclude optional services and amenities such as seat selections, meal preferences, baggage allowances beyond standard limits, travel insurance, ground transportation, and other ancillary services. These services may be available for additional fees and are subject to availability and provider policies. We will provide information about available optional services and associated costs upon request.
Potential savings claims are based on comparisons to published full-fare rates and are subject to the specific terms and conditions of each fare type. Actual savings may vary based on booking timing, travel dates, route selection, and other factors. Savings claims are estimates and are not guaranteed for any specific booking or traveler.
3. Service Quality and Performance Disclaimers
Service Delivery Standards and Limitations
BusinessClass-Flights is committed to providing high-quality travel services and customer support, but we cannot guarantee that our services will meet all customer expectations or requirements in every circumstance. Service quality may be affected by factors beyond our control including system limitations, staff availability, peak demand periods, and extraordinary circumstances that impact our operations.
Our service delivery is dependent upon the performance and cooperation of numerous third-party service providers including airlines, hotels, ground transportation companies, and technology service providers. We cannot control the quality, timing, or availability of third-party services and disclaim responsibility for service failures or deficiencies that are attributable to third-party providers.
Customer service response times and resolution capabilities may vary based on the complexity of issues, availability of information, cooperation of third-party providers, and other factors that affect our ability to provide assistance. While we strive to address all customer inquiries promptly and effectively, we cannot guarantee specific response times or outcomes for all service requests.
Performance Standards and Expectations
We maintain professional standards for our staff and operations, but we cannot guarantee that all interactions will meet every customer’s individual expectations or preferences. Service delivery may be affected by communication challenges, cultural differences, language barriers, and other factors that can impact customer satisfaction. We encourage customers to communicate their needs and concerns clearly to help us provide the best possible service.
Our travel consultants provide recommendations and advice based on their professional experience and available information, but these recommendations are not guarantees of satisfaction or suitability for individual travelers. Travel preferences are highly personal, and what constitutes satisfactory service may vary significantly between different customers. We encourage customers to provide detailed information about their preferences and requirements to help us deliver appropriate service.
The travel industry is subject to rapid changes in policies, procedures, and service standards that may affect the quality and availability of travel services. We make reasonable efforts to stay informed of industry developments and to adapt our services accordingly, but we cannot guarantee that our services will always reflect the most current industry standards or best practices.
Customer Satisfaction and Remedies
While customer satisfaction is important to us, we cannot guarantee that all customers will be completely satisfied with our services or with the travel services provided by third-party suppliers. Travel experiences are subjective and may be affected by numerous factors including weather conditions, personal preferences, cultural differences, and individual expectations that are beyond our control.
Our ability to provide remedies for service issues is limited by the policies and procedures of third-party service providers, applicable fare rules and restrictions, and other factors that may affect available options. We will make reasonable efforts to address service issues and to work with customers and service providers to find appropriate solutions, but we cannot guarantee specific outcomes or remedies for all situations.
Compensation for service issues, when available, is typically provided by the responsible service provider rather than by BusinessClass-Flights. Our role in addressing service issues is generally limited to facilitating communication between customers and service providers and providing assistance with available remedies. We do not assume financial responsibility for service failures or deficiencies that are attributable to third-party providers.
4. Information Accuracy and Reliability
Information Sources and Verification
BusinessClass-Flights endeavors to provide current, accurate, and reliable information about travel services, destinations, requirements, and other travel-related matters. However, we obtain much of our information from third-party sources including airlines, hotels, government agencies, and other service providers, and we cannot guarantee the accuracy, completeness, or timeliness of all information provided by these sources.
Travel information is subject to frequent changes due to regulatory updates, policy modifications, operational adjustments, and other factors that may affect the accuracy of previously provided information. We make reasonable efforts to maintain current information, but we cannot guarantee that all information on our website, in our communications, or provided by our staff reflects the most recent developments or requirements.
Customers are strongly encouraged to verify important information independently, particularly regarding travel documentation requirements, health and safety conditions, visa requirements, and other critical factors that may affect their travel plans. We provide information as a service to our customers, but we disclaim responsibility for decisions made based solely on information provided by us without independent verification.
Pricing Information and Accuracy
Pricing information displayed on our website, in our communications, or provided by our staff is subject to change without notice and may not reflect current rates due to the dynamic nature of travel pricing. We make reasonable efforts to maintain accurate pricing information, but we cannot guarantee that all displayed prices are current or available at the time of customer inquiry.
Pricing errors may occur due to system glitches, data transmission errors, human error, or other factors beyond our control. We reserve the right to correct pricing errors and to adjust reservations made under incorrect pricing. In cases of pricing errors, we will offer customers the option to maintain their booking at the corrected price or to cancelw ithout penalty, subject to applicable terms and conditions.
Complex pricing structures, fare rules, and restrictions may not be fully reflected in simplified pricing displays or initial quotes. Final pricing may differ from initial estimates due to the application of fare rules, taxes, fees, and other factors that become apparent during the booking process. We will provide detailed pricing information before completing any booking to ensure customer understanding and acceptance.
Destination and Travel Information
Information about destinations, attractions, accommodations, and other travel-related matters is provided for general informational purposes and may not reflect current conditions or individual experiences. Destination information is often obtained from tourism boards, travel guides, and other sources that may have promotional or commercial interests that could affect the objectivity of the information.
Travel conditions, safety situations, health requirements, and other factors affecting destinations can change rapidly and without notice. We cannot guarantee that destination information reflects current conditions or that conditions will remain stable during your travel period. Customers are responsible for monitoring current conditions and making informed decisions about their travel plans.
Cultural information, local customs, and social practices described in our materials are generalizations that may not apply to all situations or locations within a destination. Individual experiences may vary significantly based on specific locations, timing, personal interactions, and other factors that cannot be predicted or controlled.
5. Third-Party Service Provider Disclaimers
Relationship with Service Providers
BusinessClass-Flights maintains contractual relationships with various third-party service providers including airlines, hotels, car rental companies, tour operators, and other travel-related businesses. These relationships enable us to facilitate bookings and provide access to travel services, but we do not own, operate, or control the actual services provided by these third parties.
Our role as an intermediary means that we facilitate transactions between customers and service providers but do not assume responsibility for the performance, quality, or delivery of third-party services. Each service provider operates under its own terms and conditions, policies, and procedures, which may differ significantly from our own standards and practices.
Service provider relationships may change over time due to business decisions, performance issues, contractual modifications, or other factors that affect our ability to offer specific services or providers. We reserve the right to modify our provider relationships and service offerings without prior notice to customers, though we will make reasonable efforts to minimize disruption to existing bookings.
Service Provider Performance and Quality
We cannot guarantee the performance, quality, reliability, or availability of services provided by third-party providers. Service quality may vary significantly between different providers, locations, and time periods based on factors that are beyond our control. Customer satisfaction with third-party services depends on numerous variables including individual expectations, service standards, operational conditions, and external factors.
Service providers may modify their services, policies, schedules, or operations without notice to us or to customers. These modifications may affect the quality, availability, or characteristics of services that have been booked or are being considered for booking. We cannot control or predict such modifications and disclaim responsibility for their impact on customer travel plans.
Third-party service providers may experience operational difficulties, financial problems, or other issues that could affect their ability to deliver services as expected. In such cases, our ability to provide assistance or alternative arrangements may be limited by available options, timing constraints, and other factors beyond our control.
Third-Party Terms and Conditions
When you book services through BusinessClass-Flights, you become subject to the terms and conditions of the respective service providers in addition to our own terms and policies. Third-party terms may include specific policies regarding cancellations, changes, refunds, baggage allowances, check-in procedures, and other service-related matters that differ from our policies.
It is your responsibility to review and comply with all applicable third-party terms and conditions. We provide general information about key terms and policies, but we cannot provide comprehensive coverage of all third-party terms or guarantee that our summaries are complete or current. You should review the complete terms and conditions of each service provider to understand your rights and obligations fully.
Conflicts between our terms and third-party provider terms are resolved in favor of the third-party provider terms for matters relating to their specific services. Our terms govern our relationship with you and our service delivery, while third-party terms govern the actual travel services provided by those entities.
Third-Party Financial Responsibility
BusinessClass-Flights is not financially responsible for the obligations, debts, or liabilities of third-party service providers. If a service provider fails to deliver services, experiences financial difficulties, or ceases operations, your primary recourse is against the service provider rather than against us. We will provide reasonable assistance in addressing such situations, but we cannot guarantee recovery of payments or provision of alternative services.
Travel insurance may provide protection against certain types of service provider failures, and we encourage customers to consider appropriate insurance coverage for their travel arrangements. We can provide information about travel insurance options, but we do not guarantee coverage or claims processing by insurance providers.
In cases where we have collected payments on behalf of service providers, we will make reasonable efforts to facilitate refunds or credits when appropriate, but our ability to do so depends on the cooperation and financial condition of the service providers involved.
6. Technology and System Limitations
Website and Platform Functionality
Our website, mobile applications, and other technology platforms are designed to provide convenient access to our services and information, but we cannot guarantee continuous, uninterrupted, or error-free operation of these systems. Technology platforms may experience downtime, slow performance, or functionality issues due to maintenance, technical problems, security concerns, or other factors beyond our control.
System performance may be affected by internet connectivity issues, browser compatibility problems, device limitations, or other technical factors that are outside our control. We recommend using current versions of supported browsers and ensuring adequate internet connectivity for optimal system performance, but we cannot guarantee compatibility with all devices or configurations.
Data transmission over the internet involves inherent security and reliability risks that cannot be completely eliminated. While we implement appropriate security measures to protect customer information and system integrity, we cannot guarantee absolute security or prevent all possible technical issues or security incidents.
Booking System Limitations
Our booking systems integrate with multiple third-party reservation systems and databases to provide real-time availability and pricing information. However, these integrations may experience delays, synchronization issues, or data discrepancies that could affect the accuracy or timeliness of displayed information.
Booking confirmations and other system-generated communications are subject to technical limitations and may experience delays or delivery failures due to email system issues, spam filtering, or other communication problems. Customers are responsible for monitoring their communications and contacting us if expected confirmations or information are not received.
System capacity limitations may affect performance during peak usage periods, and we may implement access controls or usage limitations to maintain system stability and security. These measures may temporarily limit access to certain features or services during high-demand periods.
Data Accuracy and Synchronization
Information displayed on our platforms is obtained from various sources and systems that may not always be perfectly synchronized. Real-time data feeds may experience delays, interruptions, or inaccuracies that could affect the reliability of displayed information. We make reasonable efforts to maintain data accuracy, but we cannot guarantee that all displayed information is current or correct at all times.
Pricing and availability information is particularly subject to rapid changes and synchronization delays due to the dynamic nature of travel inventory management. Displayed prices and availability may not reflect the most current status, and actual availability and pricing are confirmed only through completed booking processes.
Customer account information and booking records are maintained in our systems, but data integrity may be affected by technical issues, system updates, or other factors that could result in temporary inaccuracies or access problems. We maintain backup systems and procedures to protect customer data, but we cannot guarantee perfect data integrity or availability at all times.
7. Travel Documentation and Requirements
Passport and Identification Responsibilities
All travelers are solely responsible for ensuring that they possess valid travel documentation required for their intended destinations, including valid passports with appropriate validity periods, government-issued identification, and any other documentation required by destination countries, transit points, or transportation providers. We provide general information about documentation requirements, but customers are responsible for verifying current requirements and ensuring compliance.
Passport validity requirements vary significantly by destination, with many countries requiring passports to be valid for at least six months beyond the intended departure date. Some destinations may require specific types of passports, minimum blank pages, or additional documentation that may not be apparent from general travel information. Failure to meet documentation requirements may result in denied boarding, entry refusal, or other travel disruptions for which we are not responsible.
Documentation requirements can change rapidly due to political developments, security concerns, health emergencies, or other factors that are beyond our control. While we make reasonable efforts to provide current information, we cannot guarantee that our information reflects the most recent requirements or that requirements will remain stable throughout your travel period.
Visa and Entry Permit Requirements
Visa requirements are complex and vary significantly based on citizenship, destination countries, purpose of travel, duration of stay, and other factors that may affect entry requirements. We provide general information about visa requirements, but customers are solely responsible for obtaining all necessary visas and entry permits for their travel itineraries.
Visa processing times can vary from a few days to several months depending on the destination, type of visa, and current processing conditions. Some destinations require advance approval, sponsor letters, or specific application procedures that may require significant advance planning. Changes in visa requirements or processing procedures can occur with little notice, and customers are responsible for monitoring current requirements.
We cannot provide legal advice regarding visa applications or immigration matters, and customers should consult with appropriate authorities or legal professionals for guidance on complex visa situations. We disclaim any responsibility for visa application outcomes, processing delays, or changes in visa requirements that may affect travel plans.
Health and Vaccination Requirements
Many destinations have specific health and vaccination requirements that must be met before entry, including proof of vaccination against specific diseases, health certificates, medical examinations, or other health-related documentation. Health requirements can change rapidly, particularly during public health emergencies, and customers are responsible for staying informed of current requirements.
We provide general information about health requirements, but customers should consult with qualified healthcare professionals and official government sources for current and complete information about health requirements for their specific destinations. Some vaccinations require advance planning and multiple doses, and customers should allow sufficient time for required medical preparations.
Health requirements may vary based on countries visited prior to arrival, duration of stay, purpose of travel, and other factors that may not be apparent from general travel information. Customers are responsible for understanding and complying with all applicable health requirements for their complete travel itinerary.
Documentation Accuracy and Compliance
All travel documentation must be accurate and match the information provided during the booking process. Discrepancies between booking information and travel documents can result in denied boarding, additional fees, travel delays, or other complications for which we are not responsible. Name changes on airline tickets are generally not permitted, and new tickets may need to be purchased if documentation does not match booking information exactly.
Customers are responsible for ensuring that all documentation is current, accurate, and compliant with the requirements of all destinations and transit points on their itinerary. We cannot verify the accuracy or adequacy of customer documentation and disclaim responsibility for travel disruptions caused by inadequate or incorrect documentation.
Documentation requirements may include specific formatting, authentication, or translation requirements that vary by destination. Customers should verify all documentation requirements well in advance of travel and allow sufficient time for any required document preparation or authentication processes.
8. Force Majeure and Extraordinary Circumstances
Definition and Scope of Force Majeure Events
BusinessClass-Flights shall not be liable for any failure or delay in performance of our obligations when such failure or delay results from circumstances beyond our reasonable control. Force majeure events include but are not limited to natural disasters such as earthquakes, hurricanes, floods, volcanic eruptions, and severe weather conditions that disrupt travel or business operations.
Human-caused events that constitute force majeure include war, terrorism, civil unrest, labor disputes, strikes, government actions, regulatory changes, sanctions, embargoes, and other political or social disruptions that affect travel or business operations. These events may occur in departure locations, destinations, or transit points and may affect our ability to provide services or customers' ability to travel.
Technology and infrastructure failures beyond our control, including cyberattacks, system failures, internet outages, power failures, and telecommunications disruptions, may also constitute force majeure events that affect our service delivery capabilities. Public health emergencies, including pandemics, epidemics, disease outbreaks, quarantine requirements, and travel restrictions, are also considered force majeure events.
Impact on Service Delivery
During force majeure events, our obligations under our Terms of Use and service agreements may be suspended to the extent that performance is prevented or delayed by the force majeure event. We will make reasonable efforts to minimize the impact of force majeure events and to resume normal operations as soon as practicable, but we cannot guarantee specific timelines for service restoration.
Force majeure events may affect our ability to process bookings, provide customer support, communicate with customers, access third-party systems, or deliver services according to normal timelines and procedures. We will provide updates and information about service disruptions as circumstances permit, but our communication capabilities may also be affected by force majeure events.
Customer service and support capabilities may be limited during force majeure events due to staff availability, system accessibility, or other operational constraints. We will prioritize emergency assistance and critical service needs, but routine service requests may experience delays during force majeure periods.
Customer Responsibilities During Force Majeure Events
During force majeure events, customers remain responsible for monitoring their travel arrangements, staying informed about changing conditions, and taking appropriate action to protect their safety and interests. This may include rebooking travel, obtaining travel insurance, making alternative arrangements, or postponing travel plans based on current conditions.
Customers should maintain flexibility in their travel plans and be prepared to make adjustments as circumstances require. Force majeure events may require rapid decision-making and adaptation to changing conditions, and customers should be prepared to modify their plans based on current information and recommendations from authorities.
We will assist customers to the extent possible during force majeure events, but our ability to provide normal levels of service may be limited by the circumstances. Customers should have contingency plans and be prepared to make independent arrangements if our normal service capabilities are disrupted.
Limitation of Liability During Force Majeure Events
BusinessClass-Flights shall not be liable for any damages, losses, expenses, or other consequences resulting from force majeure events, including but not limited to additional travel costs, accommodation expenses, lost business opportunities, missed connections, or other direct or indirect damages. Our liability limitations apply with full force during force majeure events.
Travel insurance may provide protection against losses resulting from force majeure events, and we encourage customers to obtain appropriate coverage for their travel arrangements. We can provide information about travel insurance options, but we do not guarantee coverage or claims processing by insurance providers.
Force majeure events may affect the performance of third-party service providers, and we disclaim responsibility for third-party service failures or disruptions that result from force majeure events. Customers' recourse for third-party service issues during force majeure events is primarily against the respective service providers rather than against us.
9. Financial and Payment Disclaimers
Payment Processing and Security
BusinessClass-Flights utilizes third-party payment processing services to handle customer payments securely and efficiently. While we implement appropriate security measures and work with reputable payment processors, we cannot guarantee absolute security of payment information or prevent all possible security incidents or fraud attempts.
Payment processing may be subject to delays, technical issues, or other problems that are beyond our control. These issues may affect the timing of payment confirmation, booking completion, or refund processing. We will make reasonable efforts to address payment processing issues promptly, but we cannot guarantee specific timelines for resolution of all payment-related problems.
Currency conversion for international transactions may be performed by payment processors or financial institutions, and exchange rates and conversion fees are determined by those entities rather than by BusinessClass-Flights. We are not responsible for currency conversion fees, exchange rate fluctuations, or other charges imposed by financial institutions in connection with payment processing.
Refund Processing and Limitations
Refund processing is governed by the policies of airlines and other service providers, and processing times may vary significantly based on the provider, fare type, and other factors beyond our control. We will assist with refund processing and provide updates on refund status, but we cannot control the timing or amount of refunds processed by third-party providers.
Some refunds may be processed as travel credits or vouchers rather than monetary refunds, depending on the applicable fare rules and provider policies. Travel credits may have expiration dates, usage restrictions, or other limitations that affect their value and utility. We will provide information about refund options and restrictions, but we cannot modify the terms established by service providers
BusinessClass-Flights service fees are generally non-refundable except in cases of service failure or other circumstances as determined in our sole discretion. Refund eligibility for service fees is evaluated on a case-by-case basis and may depend on the specific circumstances of the service issue or cancellation.
Financial Responsibility and Limitations
BusinessClass-Flights is not financially responsible for the obligations, debts, or liabilities of third-party service providers. If a service provider experiences financial difficulties, ceases operations, or fails to honor its obligations, customers' primary recourse is against the service provider rather than against us.
We may collect payments on behalf of service providers as part of our booking facilitation services, but this does not create financial liability on our part for the performance of third-party services. Our financial responsibility is limited to our own service delivery and does not extend to the obligations of third-party providers.
Customers are encouraged to consider travel insurance and other protective measures to safeguard against financial losses that may result from service provider failures, travel disruptions, or other events that could affect their travel arrangements. We can provide information about protective options, but we do not guarantee the adequacy or effectiveness of any particular protective measure.

You may assume the defense of the claim with counsel of your choice, subject to BusinessClass-Flights' reasonable approval of counsel and defense strategy.
Cooperation Requirements: You agree to cooperate fully with BusinessClass-Flights in the defense of any claim and to provide all necessary information, documentation, testimony, and assistance. Failure to cooperate adequately may result in additional liability and may affect your indemnification obligations.
Settlement Authority: You may not settle any claim without BusinessClass-Flights' prior written consent, which shall not be unreasonably withheld. BusinessClass-Flights reserves the right to assume control of the defense and settlement of any claim at your expense if you fail to defend the claim adequately or if settlement is in BusinessClass-Flights' reasonable business judgment.
Survival and Duration: Your indemnification obligations shall survive termination of our service relationship and shall continue for the maximum period permitted by applicable law. These obligations are in addition to any other remedies available to BusinessClass-Flights at law or in equity.

13. Privacy and Data Protection
Privacy Policy Integration and Data Handling
Your privacy and the protection of your personal information are governed by our Privacy Policy, which is incorporated by reference into this Disclaimer and forms an integral part of our agreement with you. By using our services, you acknowledge that you have read and understood our Privacy Policy and consent to the collection, use, and disclosure of your personal information as described therein.
We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, and destruction. However, no system is completely secure, and we cannot guarantee absolute security of your information. You acknowledge and accept the inherent risks associated with electronic data transmission and storage.
Data processing activities may involve the transfer of personal information across international borders to facilitate travel arrangements and service delivery. Such transfers are conducted in accordance with applicable data protection laws and appropriate safeguards to protect your information.
Data Retention and User Rights
We retain personal information only for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and applicable legal requirements. You may request information about our data retention practices and may have rights to access, correct, or delete your personal information in accordance with applicable law.
Data subject rights under applicable privacy laws may include the right to access your personal information, correct inaccuracies, request deletion, restrict processing, or object to certain uses of your information. We will respond to such requests in accordance with applicable law, but some requests may be limited by legal requirements or legitimate business needs.
We may retain certain information even after account closure or service termination as required by law or for legitimate business purposes such as fraud prevention, regulatory compliance, or dispute resolution.
Third-Party Data Sharing and Processing
Our services involve sharing personal information with third-party service providers including airlines, hotels, and other travel service providers to facilitate bookings and service delivery. These third parties may have their own privacy policies and data protection practices that differ from ours.
We require third-party service providers to maintain appropriate protections for personal information, but we cannot control their data handling practices or guarantee their compliance with privacy requirements. You should review the privacy policies of third-party service providers to understand how they handle your personal information.
Some third-party service providers may be located in countries with different data protection laws than your country of residence. By using our services, you consent to the transfer of your personal information to such countries for the purpose of facilitating your travel arrangements.
14. Regulatory and Compliance Limitations
Industry Regulation Compliance
BusinessClass-Flights operates in compliance with applicable travel industry regulations, but we cannot guarantee that all aspects of the travel industry or all service providers maintain the same level of regulatory compliance. Regulatory requirements may vary by jurisdiction and may change over time, affecting the availability or characteristics of travel services.
We maintain appropriate licenses and registrations required for our operations, but we cannot guarantee that all third-party service providers maintain adequate licensing or regulatory compliance. Customers should verify the regulatory status of service providers when such information is important to their travel decisions.
Regulatory changes may affect our ability to provide certain services or may require modifications to our service delivery methods. We will make reasonable efforts to adapt to regulatory changes, but we cannot guarantee that all services will remain available or unchanged in response to regulatory developments.
International Travel and Legal Compliance
International travel involves compliance with the laws and regulations of multiple jurisdictions, including departure countries, destination countries, and transit points. We provide general information about legal requirements, but customers are responsible for ensuring compliance with all applicable laws and regulations.
Legal requirements for international travel may include visa requirements, customs declarations, currency restrictions, import/export limitations, and other regulations that vary by country and may change frequently. We cannot provide comprehensive legal advice and recommend that customers consult with appropriate authorities or legal professionals for guidance on complex legal matters.
Some destinations may have specific legal restrictions or requirements that affect certain types of travelers, business activities, or travel purposes. Customers are responsible for understanding and complying with all applicable legal requirements for their specific circumstances and travel purposes.
Consumer Protection and Rights
We comply with applicable consumer protection laws and regulations, but consumer rights and protections may vary by jurisdiction and may not apply uniformly to all aspects of travel services. International travel may involve services provided in jurisdictions with different consumer protection standards than those in your home country.
Dispute resolution procedures and remedies available to consumers may vary based on the jurisdiction where services are provided and the specific nature of the dispute. We will provide information about available dispute resolution options, but we cannot guarantee specific outcomes or remedies for all types of disputes.
Consumer protection laws may provide certain rights regarding refunds, cancellations, or service quality, but these rights may be limited by the terms and conditions of service providers or by the international nature of travel services.
15. Modification and Termination Rights
Right to Modify Services and Terms
BusinessClass-Flights reserves the right to modify, update, suspend, or discontinue any aspect of our services at any time without prior notice. Service modifications may be necessary due to business decisions, regulatory requirements, technology changes, or other factors that affect our operations.
We may modify this Disclaimer, our Terms of Use, or other policies at any time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated through appropriate channels, but continued use of our services constitutes acceptance of any modifications.
Service availability may vary based on market conditions, provider relationships, regulatory requirements, or other factors that affect our ability to offer specific services. We cannot guarantee that any particular service will remain available indefinitely.
Termination of Service Relationships
We reserve the right to terminate or suspend customer access to our services immediately, without prior notice or liability, for any reason including but not limited to violation of our terms, suspected fraudulent activity, legal compliance requirements, or business decisions.
Termination does not relieve customers of obligations incurred prior to termination, including payment obligations, indemnification duties, and other responsibilities that may survive termination. Existing bookings and travel arrangements may remain valid after termination unless cancellation is required for legal or safety reasons.
Upon termination, customers lose access to account features and stored information, and we may delete customer data in accordance with our data retention policies and applicable legal requirements.
Effect of Modifications and Termination
Service modifications or termination may affect existing bookings, pending transactions, or other customer arrangements. We will make reasonable efforts to minimize disruption to existing arrangements, but we cannot guarantee that all arrangements will remain unaffected by service changes.
Customers are responsible for monitoring their accounts and arrangements for any changes that may affect their travel plans. We will provide reasonable notice of changes when possible, but some changes may be implemented immediately due to operational or legal requirements.
Provisions of this Disclaimer that by their nature should survive termination shall continue in effect, including limitation of liability, indemnification, intellectual property rights, and dispute resolution provisions.
16. Governing Law and Dispute Resolution
Applicable Law and Jurisdiction
This Disclaimer and your relationship with BusinessClass-Flights shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Wyoming law shall apply to all disputes, claims, and controversies arising from or relating to this Disclaimer or our services, regardless of where you are located or where the dispute arises.
Subject to arbitration requirements set forth in our Terms of Use, any legal proceedings that are not subject to arbitration shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
This choice of law and jurisdiction provision is intended to provide certainty and consistency in the interpretation and enforcement of our terms and to ensure that disputes are resolved in a forum familiar with the applicable legal framework.
Dispute Resolution Integration
This Disclaimer is subject to the dispute resolution and arbitration provisions set forth in our Terms of Use, which require binding arbitration for most disputes and prohibit class action participation. Those provisions are incorporated by reference and apply to all disputes arising from or relating to this Disclaimer.
Customers are encouraged to contact us directly to resolve any concerns or disputes before pursuing formal dispute resolution procedures. We are committed to addressing customer concerns fairly and efficiently through direct communication when possible.
The limitation of liability and indemnification provisions in this Disclaimer apply to all dispute resolution proceedings, including arbitration, and shall be considered by arbitrators and courts in determining appropriate remedies and damage awards.
